What are M and N restriction codes in Turkey? Learn about M-67, N-82, N-99, prior authorization rules, indefinite entry bans, and annulment lawsuits within 60 days.

M restriction codes are among the codes imposed on individuals for whom a Blue Notice has been issued by Interpol. A Blue Notice issued by Interpol serves the purpose of obtaining more detailed information about a person in relation to a crime. It aims to determine the person’s identity or to gather more comprehensive data. M-67 (Interpol Fraud)

The M-67 code is imposed by the Göç İdaresi Başkanlığı (Presidency of Migration Management) on foreigners who have been identified by Interpol as having committed fraud. A foreigner who has been assigned an M-67 code may enter Turkey only subject to prior authorization. This prior authorization must be obtained from the Ministry of Interior. N Restriction Codes

Codes that make entry into Turkey subject to prior authorization are referred to as N restriction codes. Foreigners for whom such a code has been imposed must obtain entry permission from the Presidency of Migration Management. However, in practice, these permission requests are mostly rejected. In case of rejection, N restriction codes effectively result in an indefinite entry ban for the foreigner. N-67 (Fraud Code)

The N-67 restriction code is imposed on foreigners who are wanted by the state for committing fraud. With this code, the entry of a foreigner wanted for fraud into Turkey is made subject to prior authorization. Furthermore, if the fraud offense has an international nature, the M-67 code is imposed instead of N-67. N-82 (Intelligence Code)

The N-82 restriction code is imposed on foreigners whose entry is subject to prior authorization. This code indicates that the foreign national’s entry into the country is conditional upon obtaining prior permission and that they cannot enter without such authorization. In order to enter Turkey, the foreign national must obtain permission from the Presidency of Migration Management. However, in practice, this permission is generally not granted. Therefore, this code effectively results in an indefinite entry ban. To remove a foreign restriction code and lift the entry ban to Turkey, please contact our lawyers specialized in immigration law.

N-95 (Administrative Fine for Violating an Entry Ban)

The N-95 restriction code is imposed when an administrative fine given to individuals who enter (or attempt to enter) Turkey despite an existing entry ban is not paid. As a result, the foreigner’s entry into the country becomes subject to prior authorization. Provincial Directorates of Migration Management or border personnel are authorized to impose this code. The required permission must be obtained from the Presidency of Migration Management. N-96 (Administrative Fine for Failure to Leave the Country Within the Granted Period)

For foreigners against whom a deportation decision has been issued, a “leave invitation” procedure may be initiated to allow them to exit the country voluntarily. Under this procedure, the foreigner is granted a period of no less than 15 days and no more than 30 days to leave the country. If the foreigner does not depart Turkey within the given period, the N-96 restriction code is imposed. Foreign nationals are obliged to provide an accurate address declaration and to notify the authorities of any change of address. Those who fail to comply with this obligation are subject to an administrative fine. The N-97 restriction code is imposed on foreigners who fail to pay the administrative fine applied due to non-compliance with these obligations or for not being found at their declared address. This code is imposed by the Provincial Directorate of Migration Management and makes entry subject to prior authorization. N-135 (Administrative Fine for Illegal Entry or Attempted Entry)

The N-135 restriction code is imposed to indicate that an administrative fine has been issued to individuals who have entered or attempted to enter Turkey illegally. In addition, foreigners who enter or exit the country through unlawful means are assigned the Ç-113 restriction code, and their entry into Turkey is banned for a period of two years. N-136 (Deportation Travel Expenses)

The N-136 restriction code is a declaratory administrative code imposed when a foreigner fails to pay their travel expenses upon leaving the country. If the foreign national does not have sufficient funds to cover these expenses, they are paid by the Treasury. However, in order for the foreigner to re-enter Turkey, these expenses must be reimbursed.

In practice, this code does not lead to a deportation decision. It is also observed that, in some cases, the Ç-136 restriction code is imposed instead. To remove a foreign restriction code and lift the entry ban to Turkey, please contact our lawyers specialized in immigration law.

N-168 (Administrative Fine for Violation of Article 102/ç)

Article 102 of the Law on Foreigners and International Protection regulates the circumstances under which administrative fines may be imposed. Pursuant to subparagraph (ç) of this article, an administrative fine is imposed on foreigners who escape:

  • While being held under administrative detention pursuant to a deportation decision,
  • While being held in a removal center,
  • During the enforcement of a deportation decision.

Foreign nationals who fail to comply with the aforementioned sanction decision are assigned the N-168 restriction code.

N-169 (Administrative Fine for Non-Compliance with Obligations Determined by the Ministry)

The Ministry may impose certain obligations on foreigners. Foreign nationals who fail to comply with these obligations are subject to an administrative fine. If they do not pay the imposed fine, the N-169 restriction code is assigned. With this code, entry into Turkey becomes subject to prior authorization. N-171 (Administrative Fine for Failure to Fulfill Prescribed Obligations)

Foreign nationals are required to cover their travel expenses when leaving Turkey under voluntary return. The N-172 restriction code is assigned if these expenses are not paid.

How to Remove a Foreign Restriction Code?

Restriction codes imposed on foreigners may be removed either by applying to the administration or by filing an annulment lawsuit.

Administrative Lawsuit for the Removal of the Restriction Code and the Cancellation of the Entry Ban

Another method for removing a restriction code and the associated entry ban is to file an annulment lawsuit. This lawsuit may be filed either without applying to the administration or after such an application has been made. The time limit for filing the lawsuit is 60 days from the date of notification of the decision. An appeal against the decision of the court of first instance may be filed within 30 days starting from the day following the notification.
